DWI With Injury
You’re Not Just Up Against a DWI in a DWI with Injury. You’re Up Against a Felony.
If you’ve been arrested for driving while intoxicated (DWI) and someone was injured in the process, whether it was a passenger, the driver of another vechicle, or even a pedestrian, the State of Texas isn’t going to treat you like someone who made a mistake.
They’re going to treat you like a criminal, and prosecutors are going to come at you hard.
You’re facing felony charges, serious jail time, and the kind of permanent record that can destroy your career, your reputation, and your freedom.
At Blizzard and Zimmerman Attorneys, attorney Jacob Blizzard knows how to fight back. He's a Texas board-certified expert in criminal law and criminal appeals, dedicated to providing exceptional defense services. He is also nationally certified in criminal trial law by the National Board of Trial Advocacy.

What Is DWI with Injury (Intoxication Assault) in Texas?
Under Texas law, if you’re accused of causing serious bodily injury to another person while driving under the influence of alcohol or drugs, you can be charged with Intoxication Assault, a third-degree felony.
That means:
- 2 to 10 years in state prison
- Up to $10,000 in fines
- Driver’s license suspension for 180 days to 2 years
- Felony conviction on your criminal record
- Mandatory drug/alcohol treatment and community service
If the injury is considered catastrophic, if the accident causes as permanent disfigurement, brain damage, or other serious injury, prosecutors may try to enhance the charges and seek even harsher penalties.
This is no longer about avoiding a DWI conviction. This is about **saving your future**.

How We Defend You
We don’t believe in cookie-cutter defenses. Every case is different. We’ll build a custom strategy based on the facts, the evidence, and your unique circumstances.
Here’s how we can help:
- Challenge the evidence- including breath and blood test results
- Investigate the accident- Was intoxication really the cause of the injury?
- Negotiate with prosecutors- to reduce the charge or avoid prison time
- Fight for dismissals or reductions- when legal errors or weak evidence exist
- Advocate for rehabilitation, not incarceration, if appropriate
You don’t need a lawyer who’s just going to hold your hand. You need one who’s going to step into the ring and fight like hell for your future.
